Robinson+Cole Lawyer Successfully Represents Insurance Associations in Eighth Circuit Case

The Eighth Circuit Court of Appeals recently issued a long-awaited decision regarding a class action against State Farm involving labor depreciation. The Eighth Circuit ruling, In re State Farm Fire and Casualty Company, reversed the district court’s decisions denying State Farm’s motion to dismiss and granting class certification and ordered the district court to dismiss the case. Insurance + Reinsurance Group lawyer Wystan Ackerman represented the American Insurance Association and Property Casualty Insurers Association of America as amici curiae in this case. The Eighth Circuit adopted the position taken by the amici. The decision is particularly significant because it is the first federal appellate decision on class certification in labor depreciation litigation and continues a recent trend of appellate decisions on the merits of the labor depreciation issue in favor of the insurance industry.
