Benjamin C. Jensen


  • Overview


    Benjamin Jensen is a member of the firm's Business Litigation Group, where he focuses his practice on three main areas: complex business litigation, intellectual property litigation, and regulatory proceedings.

    Complex Business Litigation

    Mr. Jensen represents business clients in a broad spectrum of complex litigation matters nationwide. In addition to business contract disputes, he has handled specialized subject matter, including defense of consumer class actions, commercial lease disputes, creditor’s rights proceedings, complex construction litigation, and data breach investigations and litigation. Mr. Jensen is a regular contributor to the firm’s Data Privacy + Security Insider blog, with a focus on virtual currency and blockchain technology. Mr. Jensen’s litigation experience includes jury and bench trials in state and federal courts.

    Intellectual Property Litigation

    Mr. Jensen has represented business clients in numerous intellectual property disputes in federal courts throughout the country, including patent infringement actions in the Eastern District of Texas and the Southern District of New York. He has managed major litigations in federal courts involving theft of trade secrets, trademark infringement, license disputes, and copyright infringement, including claims under the Digital Millennium Copyright Act. He also handles  proceedings before the Trademark Trial and Appeal Board. He is a member of the Janet Bond Arterton Intellectual Property Inn of Court.

    State Regulatory Proceedings

    Mr. Jensen maintains an active practice representing health care providers and corporate clients in connection with proceedings before State of Connecticut regulatory agencies, including the departments of Health, Social Services and Banking. He frequently represents providers in connection with audits of Medicaid payments before the Department of Social Services and in administrative appeals challenging the department’s sampling and extrapolation methods for determining overpayments.

    Community Involvement

    In addition to his legal practice, Mr. Jensen is actively involved in the local business and philanthropic community, having served as the chair of Hartford Young Professionals & Entrepreneurs and on the Board of Directors for the American School for the Deaf. He currently serves on the Board of Directors of The Connecticut Forum.

    Mr. Jensen has been selected to the Connecticut Super Lawyers list since 2013.

      • Represented general contractor in five-week jury trial in construction defect case, obtaining favorable verdict for client.

      • Represented major international pharmacy retailer in connection with multiple Medicaid audits. Obtained only successful administrative appeal brought in Superior Court challenging the Department of Social Service’s administration of its sampling and extrapolation methodologies for determining overpayments.

      • Successfully defended business owner in claims brought by commercial landlord for breach of lease. Following bench trial, the court ruled in client’s favor on defense of constructive eviction and awarded damages on counterclaim against landlord.

      • Obtained judgment in favor of healthcare insurer in claim brought by former broker for payment of commissions following bench trial. 

      • Successfully obtained summary judgment and damages in excess of $1 million in representing former member of a limited liability company in a dispute over his buyout agreement in a decision that was upheld by the Connecticut Supreme Court.

      • Successfully litigated case on behalf of software provider against licensees alleging copyright infringement and circumvention of security measures in violation of Digital Millennium Copyright Act, obtaining favorable settlement for client.

      • Represented developer of patented healthcare auditing system in patent infringement and trade secret misappropriation action in the Southern District of New York.

      • Represented ticketing software company in defending patent infringement claims and in license disputes in actions brought in the Eastern District of Texas.

      • Successfully obtained dismissal of consumer class action on behalf of major insurance company in claims brought in New York state court involving obligations of insurer in connection with exercise of subrogation rights.

      • Represented national cosmetics manufacturer in litigation in the Southern District of New York alleging infringement of design patents.

      • Representation of major regional bank in defending class action alleging assessment of improper late charges regarding open-ended credit agreements.
      • Successfully argued before the Connecticut Appellate Court on behalf of a national mortgage lender that a mortgage was not a consumer contract pursuant to Connecticut General Statutes Section 42-150bb.

      • Represented international manufacturer of components for military helicopters in complex trade secret litigation in the District of Connecticut.

      • Represented health care center in challenges to Department of Social Services Medicaid reimbursement rate appeals.

      • Represented mortgage lender and servicer in defending consumer action alleging violations of state and federal debt collection practices laws, striking all claims from case related to lender's reporting of credit information to agencies.

      • Represented nutritional supplement company in defending patent infringement allegations filed in the Eastern District of Texas.

      • Represented national automotive service company in defending trademark infringement action in the Southern District of Ohio.
